The case filed by Abia state Government and abia state governor using a proxy personality with name as Izuchukwu onwughara against Rt honourable obinna ichita, the only Apga and miniority house of assembly member in Abia state , in other restrain him hon obinna ichita from critising constructively the abnormalities going on in Abia state as pertaining to the abia state government not fixing or embarking on any roads project in Abia state for which they got 56.4 million US dollars from the world bank, held at the umuahia high court presided over by Justice Benson anya, as it was reported by newsmen that Honourable obinna Ichita has constructively been critising the Abia state Governor ikpeazu ,who has been using one of his proxy/surrogates in the person of valentine onwughara to stiffle Rt hon obinna ichita from talking and expressing his opinions on the state of abia state roads and Abia state govt fund expenditures. The claimant in the above suit in the person of Valentine onwughara and who is incidentally is also the man who double as the signatory to the abia state government account in Zenith Bank. Where abia state government funds with the money in the said account is being squandered about without no proper accountability.The claimant in this case,in the person of Izuchukwu onwughara who sued honourable obinna ichita is also asking the court to restrain permanently honourable obinna ichita from further critising and speaking about the money that Abia State government got from the world bank,which is unjustly spent by Governor ikpeazu of Abia state without no reasonable justification for the expenditure .
Rt hon obinna ichita in his filed statement of defense wiill be calling an armada of very credible witnesses to support his position that the Abia State government and the Governor received on or about 56..4 million dollars from the world bank.
At the court sitting of on 11th February 2021, When the lawyers of Abia State government and that of Valentine onwughara saw the list of Rt hon obinna ichita witnesses, they all absented and were no longer seen in the court sitting of on 11th February 2022. The presiding Judge , Justice Benson Anya in one of his passing remarks, opined that no court in Nigeria can restrict a citizen from exercising his freedom of expression ,let alone an elected representative of the abia state house of assemble.
He then adjourned the matter to 11th March, 2022 for commencement of hearing on the substantive suit.
Speaking on the above matter, legal representative of one love foundation, Samuel ihensekhien jnr esq, stated that the suit filed by Valentine onwughara against honourable obinna ichita is an attack on the concept of free speech, open access to information and blatant attack on accepted democratic and constitutional rights to freedom of expression, that can never stand and that one love foundation will support Rt hon obinna ichita in all ways, to defend this suit in this regard, he concluded.
