The Supreme Court has dismissed the suit seeking the disqualification of Bola Tinubu and Kashim Shettima as presidential and vice-presidential candidates of the All Progressives Congress (APC).
A five-member panel of the Supreme Court held on Friday that the Peoples Democratic Party (PDP) lacked the locus standi to institute the suit.
The panel said the PDP is not a member of the APC.
The PDP had claimed that Shettima’s nomination as Tinubu’s running mate was in breach of the provisions of sections 29(1), 33, 35, and 84(1)(2) of the Electoral Act, 2022.
The opposition party argued that Shettima’s nomination to contest the position of vice-president and Borno central senatorial seat — at the same time — contravened the law.
Abujapress reports that PDP and its supporters had expected that the ‘treatment meted out’ on David Lyon of Bayelsa by the Supreme Court would be repeated on Tinubu.
Recall that the five-member panel of the apex court led by now former Justice Mary Odili nullified the election of Lyon a few hours to his inauguration on the grounds that his running mate, Biobarakuma Degi-Eremienyo, presented false information to the Independent National Electoral Commission (INEC) in aid of his qualification for the November 16 governorship election in the state.
The apex court in the judgment delivered by Justice Ejembi Eko in the suit instituted by Douye Diri, consequently ordered INEC to withdraw the Certificate of Return issued to Messrs Lyon and Degi-Eremienyo.
Abujapress reports that the spokesman of the PDP presidential campaign council, Daniel Bwala, had expressed high hope on the PDP’s suit on Wednesday, saying only God would determine who will be sworn in as Nigerian president on May 29, 2023.
